General Terms and Conditions (GTC) for Retreats, Prayer and Meditation Days, Seminars, and Other Events (with or without lodging)
Operator
SARADA HOME Germany gUG (limited liability),
hereinafter referred to as “gUG” or “Organizer.”
Purpose
Conducting spiritual/meditative seminars and retreats, as well as providing optional lodging and meals in connection therewith at the monastery, seminar, and retreat center.
§ 1 Scope
(1) These General Terms and Conditions apply to all contracts entered into by the gUG regarding participation in retreats, days of prayer and meditation, courses, and other events, such as Karmayoga, as well as to the related lodging and meals.
Upon conclusion of the contract, our General Terms and Conditions (GTC) are deemed accepted; these may be viewed in advance on our website and, upon request, at our premises.
(2) Any deviating terms and conditions of the customer (hereinafter “Participant”) will not be recognized unless gUG expressly agrees to their validity in writing.
§ 2 Two-Stage Contract Model & Conclusion of Contract
(1) The contracts for participation in the program and the subsequent booking of lodging and meals are, in accordance with regulations, legally and financially separated into two stages.
(2) Stage 1 (Retreat Participation): By submitting the online booking form or making a booking via email or phone for a retreat, the participant submits a binding offer to enter into a seminar contract; this will be confirmed in writing by the gUG.
The contract is not legally binding until the gUG has confirmed the booking in writing and the seminar fee has been paid in full (therefore, as long as payment has not been made, another participant may, in principle, be given preference to cover costs).
(3) Step 2 (Lodging & Meals): The intention to use on-site lodging and meals must be indicated during online registration. However, the final, binding lodging and meal contract is not concluded until **on-site on the day of arrival**, either by signing a participant agreement in writing or directly upon payment.
§ 3 Exclusivity (Tying Clause) & Nonprofit Status
(1) The gUG pursues exclusively and directly charitable purposes. All revenue is directed toward the tax-exempt purpose of operating the facility.
(2) The provision of lodging and meals takes place **exclusively within the framework of and only in connection with** participation in prayer, meditation, retreat days, or other events. A hotel reservation or lodging without participation in the program is not permitted, as this is not legally allowed for the gUG.
§ 4 Prices, On-Site Payment & Wi-Fi Outage Clause
(1) The seminar fee (Level 1) must be paid in advance in accordance with the booking details (via the Internet, email, or phone) following confirmation of the reservation.
(2) The fees for lodging and meals (Level 2) are **due immediately upon check-in on-site on the day of arrival** and must be paid in full before checking into the room, with a receipt provided.
(3) The following payment methods are accepted on site:
-
Cash payment on site (in euros)
-
PayPal (e.g., via the property’s QR code)
-
Zeffy app via the gUG’s device using credit cards
-
Banking app (via guest’s device/cell phone) via QR code (Sofortüberweisung/GiroCode)
-
SEPA functionality on the Zeffy platform for campaigns offered there (e.g., retreats).
(4) All transaction, exchange rate, or bank fees (particularly for foreign accounts) are the sole responsibility of the participant.
(5) The participant may choose whether to receive the receipt digitally via email or as a traditional paper copy.
(6) Wi-Fi / System Outage: In the event of technical malfunctions on site (e.g., internet outage, card terminal failure, or QR code system failure, etc.), the participant is required to either pay the amount in cash or make a real-time mobile transfer via their own mobile network.
§ 5 Cancellation Policy & Cancellation by International Speakers
(1) Cancellation by the gUG: As the organizer, the gUG reserves the right to cancel a retreat, seminar, lecture, or other event up to 14 days before it begins if the minimum number of participants is not reached. In this case, any seminar fees already paid will be refunded in full. Any further claims (e.g., for flight or train tickets booked privately by the guest) are excluded.
(2) Cancellation by the participant (seminar fee): Withdrawal from the retreat must be made in writing. The following cancellation fees for the seminar fee then apply:
-
Up to 14 days before the start: free of charge
-
14 days or less before the start: €25
(3) Compensation for reserved accommodations: If a participant cancels at such short notice (< 14 days before the start) that the accommodation announced and reserved for them can no longer be reallocated, the gUG reserves the right to charge a flat-rate compensation of 10% of the agreed accommodation and meal costs, even if the contract has not yet been finalized on site.
(4) Clause for international guest speakers: In the event that an announced (international) speaker is unable to attend due to illness, visa issues, airline strikes, or force majeure, the gUG is entitled to appoint a qualified replacement speaker or to adjust the program. There is no right to a free cancellation or a reduction in fees as long as the overall nature of the retreat remains intact.
§ 6 Monastery and Retreat Center Clause (House Rules)
(1) The facility is run in the spirit of a monastery.
The currently valid house rules are an integral part of the contract; therefore, they must be respected and followed for the common good.
(2) The participant agrees to observe the designated periods of silence, the nighttime quiet hours (beginning at 9:30 p.m. or as specified by the program schedule), and the strict prohibition on alcohol, tobacco products (on the premises), and other addictive substances.
(3) In the event of gross and/or repeated violations of the house rules despite verbal and/or written warnings, or in the event of a sustained disruption of the retreat’s peace, the gUG is entitled to exclude the participant from the retreat or any other event without notice and to immediately expel them from the premises for the common good. In such cases, no refund of fees will be granted.
§ 7 Participants’ Personal Responsibility
Participation in the retreats and meditations is entirely at the participant’s own risk. These programs are not a substitute for medical, psychiatric, or psychotherapeutic treatment. The participant hereby certifies that they are mentally and physically capable of participating in the booked program.
§ 8 Liability
The gUG is liable for damages resulting from injury to life, limb, or health in accordance with statutory provisions. For other damages, the gUG is liable only in cases of willful misconduct or gross negligence. No liability is assumed for personal belongings or valuables brought onto the premises.
§ 9 Final Provisions / Severability Clause
The laws of the Federal Republic of Germany shall apply. Should any individual provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
